Relations between the sexes was a pervasive concern of ancient Greek thought and literature, extending from considerations of masculine and feminine roles in domestic and political spheres to the organization of the cosmos in a pantheon of gods and goddesses. In Playing the Other Froma Zeitlin explores the diversity and complexity of these interactions through the most influential literary texts of the archaic and classical periods ranging from epic (Homer) and didactic poetry (Hesiod) to the theatrical productions of tragedy and comedy in fifth-century Athens. Zeitlin demonstrates the indispensable workings of gender as a major factor in Greek social, religious, and cultural practices and in more abstract ideas about nature and culture, public and private, citizen and outsider, self and other, and mortal and immortal. Focusing on the prominence of female figures in these male authored texts, she enlarges our perspective on critical components of political order and civic identity by including issues of sexuality, the body, modes of male and female maturation, and speculations about parentage, kinship, and reproductive strategies. Abstract This paper discusses the phenomenon of single women claiming, and acquiring, residential sites in the former homelands since the end of apartheid in 1994, against the backdrop of steadily declining marriage rates. It argues that the transition to democracy changed the balance of power within which 'living customary law' is negotiated at the local level, and emboldened women. The changes are put at risk by controversial traditional leadership laws enacted since 2003. These restore the power of definition to chiefs, and reassert constructs of customary law that obscure the dynamics of the changes under way. I suggest that the 'changes' may, in part, reflect the re‐emergence of pre‐existing repertoires that were suppressed by official customary law. The paper contrasts the Constitutional Court's inclusive approach to 'living customary law' and the legislative process, with the autocratic approach of the new laws, one of which has already been struck down by the Court.

It explains that aboriginal customary law can be a source of common law title to land in former British colonies, whether they were acquired by settlement or by conquest or cession from another colonising power. The doctrine of Common Law Aboriginal Customary Title provides a coherent approach to the source, content, proof and protection of Aboriginal land rights which overcomes problems arising from the law as currently understood and leads to more just results. The doctrine's applicability in Australia, Canada and South Africa is specifically demonstrated. While the jurisprudential underpinnings for the doctrine are consistent with fundamental common law principles, the author explains that the Australian High Court's decision in Mabo provides a broader basis for the doctrine: a broader basis which is consistent with a re-evaluation of case-law from former British colonies in Africa, as well as from the United States, New Zealand and Canada. In this context, the book proffers a reconceptualisation of the Crown's title to land in former colonies and a reassessment of conventional doctrines, including the doctrine of tenure and the doctrine of continuity. 'With rare exceptions ... the existing literature does not probe as deeply or question fundamental assumptions as thoroughly as Dr Secher does in her research. She goes to the root of the conceptual problems around the legal nature of Indigenous land rights and their vulnerability to extinguishment in the former colonial empire of the Crown. This book is a formidable contribution that I expect will be influential in shifting legal thinking on Indigenous land rights in progressive new directions.' The contributions included in this book, all written by renowned scholars, examine some of the long-standing fundamental issues of international law. The main part concerns the question: how is international law made and applied? A highly original, systematic assessment of the formation of customary international law by Herman Meijers - now for the first time published in English - provides an answer to this question. Two other long-standing fundamental issues are examined. Firstly, the plausibility of the hypothesis that international law is complete on the basis of the existence of a so-called 'closing rule'. Secondly, a study of the principle of the genuine link in the modern law of the sea demonstrates that its livelihood is so limited that a post mortem is justified. The volume is concluded by a discussion on a paradoxical aspect of the law of treaties, namely regarding the right of the parties to terminate their agreements.
